Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Motozy ("Motozy", "we", "us") for your use of the Motozy Car mobile app and the website at car.motozy-app.com (together, the "Service"). By creating an account, accepting an invitation or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you confirm you have authority to bind that business. If you do not agree, do not use the Service.
The Service
Motozy Car is business management software for car rental operators. It helps you keep track of your fleet, bookings, customers, drivers, payments, deposits, fines, expenses, documents and reports, and to prepare and share receipts and invoices. Motozy provides software only. We are not a party to any rental between you and your customers, and we do not provide insurance, legal, tax or accounting advice. Disputes, damage, refunds, fines and legal issues arising from your rental business are between you and your customers.
Accounts and eligibility
- You must be at least 18 and able to form a binding contract.
- You can sign in with a mobile number, an email address and password, or a Google account. Give accurate information and keep it up to date.
- The Owner is the person who creates the business account and is responsible for it, including the people they invite as Managers or Staff and what those roles can see or do.
- Keep your sign-in details secure. You are responsible for activity under your account, and you must tell us promptly if you suspect unauthorised use.
Free trial and subscriptions
- Free trial. A new business can use every feature free for 3 days from sign-up. No payment details are needed to start the trial.
- Subscription. To keep using the Service after the trial you must subscribe to a monthly or yearly plan. Until you subscribe, access is paused; your data is kept safe and is available again once you subscribe.
- Billing. Subscriptions are sold, billed and managed by Google Play. Prices, taxes, renewal and payment follow Google Play's terms. Subscriptions renew automatically at the end of each period until cancelled. Motozy does not process payments and never sees your card details.
- Cancellation. You can cancel at any time in Google Play (Play Store → Profile → Payments & subscriptions → Subscriptions). You keep access until the end of the period you have paid for. Deleting the app does not cancel a subscription.
- Refunds. Refunds are handled by Google Play under its refund policy. Except where the law requires otherwise, payments are non-refundable and we do not give partial refunds for unused time.
- Price changes. We may change prices for future billing periods. Google Play will notify you as required and the change will apply only if you continue your subscription.
Your data
You own the business data you enter ("Your Data"). You give us a limited licence to host, copy, process and display Your Data only as needed to provide and support the Service. You are responsible for Your Data and for having every right, permission and consent needed to collect it and to store it in the Service, including customers' licence and ID details and photos, under the laws that apply to your business. You must keep your own records and backups where the law requires. Our handling of personal information is described in the Privacy Policy.
Acceptable use
You agree not to: break any law or the rights of others; enter data you have no right to collect; send spam or unwanted messages; try to access another business's data or accounts; probe, scan or test the Service's security; interfere with or overload the Service; copy, reverse engineer or resell the Service; or use it to build a competing product.
Messages
We send service messages such as one-time codes, security and account notices, subscription notices and reminders. Product news and offers can be switched off in Settings. Receipts, reminders and review requests to your customers are sent by you from your own WhatsApp or other messaging app when you choose; you are responsible for their content and for meeting the consent and messaging rules that apply to you.
Our rights
The Service, including its software, design, text, graphics, logos and the Motozy name, belongs to Motozy and its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and website for your business during your subscription or trial. All rights not expressly granted are reserved. If you send us feedback, we may use it without obligation to you.
Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. It relies on third parties, such as hosting providers, mobile networks, Google Play and WhatsApp, that we do not control. We may add, change or remove features, and we may update the app; for security or compatibility we may require an update to keep using it.
Termination
You may stop using the Service and delete your account at any time (Settings → Delete my account or the account deletion page). We may suspend or end your access if you breach these Terms, if your subscription is unpaid or has ended, if required by law, or if your use puts the Service or others at risk. When an Owner deletes a business, access ends immediately and the data is erased after 30 days, as described in the Privacy Policy. Sections that by their nature should survive termination will survive.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Motozy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Reports, totals, reminders and other calculations are aids to your own judgement; check them before relying on them for legal, tax or financial decisions.
Limitation of liability
To the fullest extent permitted by law, Motozy and its owners, directors, employees and partners will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, and consumers keep the mandatory rights they have under local law.
Indemnity
You will defend and indemnify Motozy against claims, losses and expenses (including reasonable legal fees) arising from Your Data, your use of the Service in breach of these Terms or the law, or your dealings with your customers.
Governing law and disputes
These Terms are governed by the laws of the country in which Motozy is established, without regard to conflict-of-law rules, and the courts of that country have jurisdiction, except where mandatory local consumer-protection law gives you the right to bring a claim in the courts of your own country. Before starting a claim, please contact us so we can try to resolve it informally.
General
These Terms and the Privacy Policy are the whole agreement between you and Motozy about the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
Changes to these terms
We may update these Terms. If a change is material we will update the date above and give notice in the app or by email before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.
